COENA SAS is the company responsible for publishing the website www.coena.fr and for producing and marketing its products and services, including iCartedesvins, DigitalMenu, and Satisfact.

Data privacy is a priority for COENA SAS. To ensure full transparency, the company has drafted this Privacy Policy.

As part of this approach, COENA SAS listens to its Clients (hereinafter referred to as the « Client, » « User, » « Internet user, » or « Visitor »). If you have any questions about this Privacy Policy, please contact us by email (support@coena.fr) or by any other means to obtain further information.

In the course of its business and the products it offers for sale — notably iCartedesvins, DigitalMenu, and Satisfact — COENA SAS collects data. This private data falls into two categories:

  • Personal data of the COENA client: data that directly or indirectly identifies a person within a company that is a COENA client, collected when the company’s account is created on the COENA website (the « Website ») or via the application.
  • Data of the customers/consumers of the COENA product: data collected from the customers (consumers) of COENA’s clients, collected via the applications.

The application, the Website, and any document or medium, paper or digital, issued by COENA SAS for the purpose of collecting data, are hereinafter referred to as the « Service. »

1. Protection of Personal Data under the law

The collection and processing of Personal Data carried out when the Client uses the Services is performed in accordance with Law 78-17 of 6 January 1978 on information technology, data files, and civil liberties (« Informatique et Libertés »).

Data processing is subject to a declaration to the CNIL (the French data protection authority). You have the right to access, modify, rectify, and delete data concerning you, at any time. To exercise this right, simply send your request by post to COENA SAS’s registered office at 3 rue Toulouse Lautrec, 31170 Tournefeuille, France, or by email to guillaume@coena.fr.

COENA SAS will make every effort to respond to the Client’s request within the legal time limit.

2. General information on cookies and data collected during your visit

When an internet user accesses COENA SAS’s Services from the Website, certain non-personal data is retained.

This information, collected automatically using various technologies, does not allow the internet user to be precisely identified. Accordingly, this information is not considered Personal Data.

COENA SAS may store this information itself, and/or it may be kept in a database held and managed by COENA SAS’s subsidiaries, agents, or service providers. The Website may use this information and cross-reference it with other information, for example to record the total number of visitors accessing the Site, the number of visitors viewing each page of the Site, and the domain name of each visitor’s internet service provider.

It is important to note that no Personal Data is available or used during this process.

In operating the Website, COENA SAS uses technology known as « cookies. » A cookie is a piece of information that the computer hosting the Website provides to the internet user’s browser when they access our Site. Cookies help provide additional functionality to the Website and allow its use to be analyzed more precisely. For example, the Website may set a cookie in the user’s browser to allow access to the Site without having to enter a password more than once.

In some cases, prior written consent will be requested before certain types of cookies can be used. Where cookies are used, COENA SAS only collects personal information with your authorization. COENA SAS recommends leaving cookies enabled, as they allow you to take advantage of certain features of the Site and the Services.

3. Information collected by COENA SAS

Each time the Client interacts with COENA SAS through the Services, Personal Data is collected, along with other information, as detailed further below:

  • Client Personal Data that you provide following your registration on the Website, and/or when placing an order on the Website, and/or when configuring the application. This Personal Data includes, in particular: email address, first and last name, address, mobile and/or landline phone number, wine/cocktail lists, and food, digestif, and aperitif menus. Except in connection with a product purchase order on the Website, COENA SAS does not collect any information relating to your credit card or any other financial information. The company also collects information when you install a COENA Product, such as the number of requests made to the server during data synchronization, and the time and date. COENA SAS may also collect Personal Data through automated means used to monitor or operate the Services, such as, but not limited to, information about your Product, its capabilities and applications, how it is used, activities related to the Services, the user’s IP address, browser, etc. COENA SAS also records your password(s). These are, however, inaccessible and can never, under any circumstances, be used by COENA SAS.
  • Consumer Personal Data provided via the application: COENA SAS collects Personal Data from consumers (customers of our clients) and Measurements within its applications. This includes: first and last name, email, mobile phone number, satisfaction rating, and preferred product. This data is shared with our clients. Any collection of personal data is clearly and precisely disclosed within the applications.
  • Personal Data provided via other COENA SAS Services. For example, COENA SAS collects Personal Data when a user responds to an online survey, signs up for a promotional or special offer, sends an email, participates in a forum, or interacts with our blog articles.

By voluntarily providing us with Personal Data and Measurements, the Client consents to COENA SAS using them in accordance with the terms of this Privacy Policy. If the internet user provides Personal Data and Measurements through the Services, they acknowledge and accept that this Personal Data and these Measurements may be transferred from their location to the offices and servers of COENA SAS’s hosting providers, and to any other authorized third parties referred to in sections 4 and 5 of this document, all located within the European Union.

4. Use of your Personal Data and other Information

It is reiterated here that COENA SAS uses Personal Data and Measurements in accordance with this Privacy Policy.

COENA SAS only uses the Client’s Personal Data and Measurements for their intended purposes, including, but not limited to, the purposes described below:

  • Performance and monitoring of the Services: COENA SAS uses the Personal Data of clients and consumers, and Measurements, to enable access to the Services and to monitor their use. As part of the Services, COENA SAS uses your Personal Data and Measurements to provide you with personalized analysis and advice. In accordance with French law, users may also retain, verify, and modify their Personal Data, Measurements, or any other information on our Site or Services. A simple email request is sufficient. This will be confirmed by return email. Actions taken will be effective within a maximum of 30 clear days (the legal deadline).
  • Sharing of personal data and measurements with the client: COENA SAS shares the Personal Data and Measurements of consumers at our client’s establishment with that client. The client undertakes to use this personal data and these measurements exclusively for commercial purposes, such as — this is a non-exhaustive list — sending the Client a tailored offer or responding to a service review. This personal data remains the property of the Client. The Client has the right to access, modify, and delete this Personal Data and these Measurements.
  • Surveys, contests, and other special offers. From time to time, COENA SAS offers its clients the opportunity to take part in surveys, contests, and other special offers. If, on this occasion, the client provides Personal Data, this Personal Data will only be used for these specific purposes.
  • Questions and requests. If the internet user contacts COENA SAS by email or any other means, the Personal Data provided will only be used to respond to or resolve the matter, unless an additional use is stated on the information collection form.
  • Communications about Products, Services, and Events: when a user registers for COENA’s Services, they agree that COENA SAS may, from time to time, use their Personal Data to contact them in the future and keep them informed about Products, Services, and events that may be of interest. These communications will always allow the option to opt out at any time, upon simple request.
  • Data research and analysis: in order to understand and meet the needs of the users of its Site and Services, COENA SAS regularly conducts research on the profile, interests, and behavior of its clients and consumers, as well as on the measurements gathered by its applications. This research is based on data, measurements, and other information. It may be compiled and analyzed as raw or aggregated data, and COENA SAS may share this data with advertisers, researchers, business partners, publications, or any other third party.
  • Service improvement: COENA SAS may use Personal Data, Measurements, aggregated Personal Data, or any other anonymized data collected through the Services to improve the content and functionality of the Services, to better understand users, and to improve our Services.
  • Orders: COENA SAS may use Personal Data collected through the Site to fulfill orders for Products that may be placed via COENA SAS’s Services. Notwithstanding anything to the contrary herein, COENA SAS will use the Client’s credit card and any other financial information solely for the purpose of processing and fulfilling the order, and always with prior consent.

5. Disclosure of your Personal Data and other Information

COENA considers Personal Data and privacy to be central to its relationship with the Client.

However, in certain circumstances, some Personal Data and Measurements may be shared with third parties and used by those third parties, without further notice, in the cases mentioned below:

  • Business transfers: as COENA SAS grows its business, the purchase and sale of certain activities is possible. In the event of a sale, merger, reorganization, dissolution, or similar transaction, Personal Data and Measurements may be among the assets transferred.
  • COENA SAS’s internal operational functions: like many other companies, COENA SAS sometimes uses other companies to carry out certain internal operational functions, such as sending postal mail, maintaining databases, auditing the Services, etc. When a third party is used, only the information specifically necessary for their tasks is provided; this information is used solely for COENA SAS’s internal needs.
  • Legal requirements: COENA SAS may disclose Personal Data where required by law, or where it believes in good faith that this is necessary to comply with a legal obligation, to protect or defend the rights or property of COENA SAS, to act in an emergency to defend the personal safety of Site users or the public, or to ensure protection against legal liability.
  • Third parties acting on the Client’s action or authorization: if the Client decides to share their Personal Data or Measurements on platforms other than the Website or the Services — such as, but not limited to, social media sites — or to make their Personal Data or Measurements available to all other users or third parties, the Client should be aware that this Personal Data or these Measurements may be used by any third party.
  • Anonymized Personal Data: as noted above, we may share information relating to your Personal Data that does not itself constitute Personal Data. For example, we may share aggregated, raw, or anonymized data with advertisers, researchers, business partners, publications, or any other third party.

6. Your choices

The Client may use the Site without providing Personal Data. However, if the Client chooses not to provide Personal Data, certain areas of the Site and applications may not be accessible or fully functional.

The Client may choose whether or not to be contacted by COENA SAS and/or by third parties offering products, Services, and/or events that may be of interest.

7. Exclusions

This Privacy Policy does not apply to personal data collected by COENA SAS other than the Personal Data and Measurements collected through the Site, the Services, and the Products.

This Privacy Policy does not apply to unsolicited information that the Client provides to COENA SAS through the Site or by any other means. This includes, but is not limited to, information posted in any public area of the Site, such as product comments and reviews, any new ideas relating to Products or modifications to existing Products, and any other unsolicited information (the « Unsolicited Information »). All Unsolicited Information is considered non-confidential, and COENA SAS is free to reproduce, use, disclose, and distribute such Unsolicited Information to third parties, without limitation or compensation.

8. Links to other websites

This Privacy Policy applies only to COENA SAS’s Site or Services. The Site may display links to other sites not operated or controlled by COENA SAS (the « Third-Party Sites »). The policies and procedures described here do not apply to Third-Party Sites. Links from the Site in no way imply that COENA SAS approves of or has verified such Third-Party Sites. COENA SAS advises the Client to read the privacy policies of Third-Party Sites or to contact them directly for more information on their data management policies.

9. Security

COENA SAS takes reasonable measures to protect your Personal Data provided through the Site against loss, misuse, unauthorized access, disclosure, alteration, or destruction.

However, no transmission over the internet or by email is ever completely secure or error-free. As such, the security of emails sent to or from the Site cannot be guaranteed. We encourage users to exercise particular caution when sending information via email or internet transmissions.

10. Changes to COENA SAS’s Privacy Policy

The Site, Services, and COENA SAS’s activities may evolve over time. As a result, COENA SAS may need to make changes to its Privacy Policy. COENA SAS reserves the right to update or modify this Privacy Policy at any time, without notice. COENA SAS invites Clients to visit and read this Privacy Policy regularly, particularly before providing Personal Data or Measurements. Continued use of the Site after this Privacy Policy has been changed or revised constitutes acceptance of such changes.
